THE 2022 ZWIFT ACADEMY TRIATHLON PROGRAM TERMS AND CONDITIONS
The 2022 Zwift Academy Triathlon Program (the “Academy” or the “Program”) is sponsored by Zwift, Inc. (“Sponsor” or “Zwift”). By enrolling in the Program you (the “Participant”) acknowledge that you have read, understand and agree to the following Terms and Conditions (the “T&Cs”).
Opportunity
This is a once in a lifetime experience to be a part of the Zwift Academy Triathlon Team (the “Team”), with support from Zwift and various other partners of the Program (the “Program Partners”), with the goal of qualifying for and racing at the 2023 Ironman World Championships in Kona, Hawaii (“Ironman”).
Eligibility
By registering in the Zwift Academy Triathlon Program for selection on the Zwift Academy Triathlon Team, you represent that you are: (i) an amateur triathlete, in good health, aged 18 years or older as of December 31, 2022, (ii) not currently racing in the professional category or having any personal sports sponsorships other than with the Sponsor, and (iii) meet the eligibility requirements of the Ironman as of September 1, 2023. Employees of Zwift or the Program Partners are not eligible to participate. The Academy reserves the right to verify the eligibility of Participants at any time during the Program including both physical/physiological performance verification and anti-doping tests. Participants must be users of the Zwift platform in good standing Participants shall not be eligible where prohibited or restricted by applicable law.
Failure to comply with any verification procedures required by Zwift will result in disqualification from the Program. In the event of any dispute concerning the eligibility of any Participant in the Program, Zwift’s decision shall be final.
Selection Process/Team Participation
To register to participate in the Program, go to http://www.zwift.com/zatri and follow the directions presented to complete and submit your information. Registration will begin at 8:00 am United States Pacific Time (“PT”) on October 10, 2022 and ends at 1:59 am PT on November 20, 2022.
Beginning October 24, 2022 through November 20, 2022, Participants must complete and graduate from the Program. The Program consists of completing three (3) cycling workouts, one (1) Finish Line Bike event, three (3) long run workouts, and one (1) Advanced Finish Line Run event on the Zwift platform.
Upon completion of the Program, between 100 (one hundred) and 200 (two hundred) Participants will be determined (at Sponsor’s sole discretion) as Semi-Finalists based on, among other things, their performance in the Academy. The Semi-Finalists will be contacted via email and required to complete an application in its entirety (the “Application”). Applications will be accepted from November 21, 2022 through December 20, 2022.
All Applications may be reviewed and evaluated by Sponsor and Sponsor, agents and representatives associated with the Zwift Academy Triathlon Team (collectively, the “Selection Panel”) based on criteria including, without limitation, performance potential, previous race results, ability and willingness to meet the Team training schedule, ability and willingness to participate in scheduled Team training events and camps, ability and willingness to race at the 2023 Ironman World Championship, including any necessary qualifying races and triathlon related presence and activity on social media as well as within the triathlon community. Participants may be subject to physical and physiological performance verification, including anti-doping tests.
After reviewing Applications, between 25 (twenty-five) and 50 (fifty) Participants will be determined as Finalists (at Sponsor’s sole discretion). The Finalists will be contacted and provided instructions to submit a 5 (five) minute video to provide the Selection Panel an insight into Participant’s life, both inside and outside of the sport of triathlon. Requirements for the video will be provided to Participants prior to submission. Participants who do not submit the video by the deadline communicated by the Sponsor shall forfeit their opportunity to participate.
After reviewing the video submissions, Zwift will determine the 6 (six) Zwift Academy Triathlon Team members. The Team member announcement will take place on or about March 1, 2023. Selected Team members will then receive further instructions and information on participation requirements, training, events and perks that are part of being an active Team member.
Team members will be guided by pro level mentors to train and will be expected to bring the Zwift Community along with them on their road to Kona. Each Team member will enter into a Strategic Partnership Agreement with Zwift and interact with the greater Zwift community by participating and potentially leading group workouts, posting videos of their progress on their social media channels, and participating in different events both in real life and in game throughout the length of the Program.
Data Protection Privacy/Compliance
Any information (including data, images and/or video) related to the Participant that is collected or processed (which includes collection, storing, holding and carrying out operations) by the Academy at the beginning and during the course of the Program will be held and used by the Academy, members of the judging committee and their suppliers and contractors (e.g., travel agencies etc.) to administer the Program in accordance with these Terms and Conditions and Zwift’s Privacy Policy (http://zwift.com/privacy/).
Aggregate, non-personal data may also be used by the Academy and/or Zwift for the purpose of undertaking market research or in facilitating reviews, developments and improvements to relevant services. Participants’ personal data may be used to send Participants news and publicity material in relation to the Program.
By enrolling in the Zwift Academy Triathlon Program, all Participants will have consented to the transfer of their personal data to the Academy, to Zwift and to each of their Partners, suppliers, contractors and agents for the purposes of the administration of this Program and pursuant to these T&C.
The Zwift Academy Tri confirms that all personal data requested from a Participant is necessary for the purposes of participating in the Program. Participants shall be entitled to access, rectify, complete, update, block or delete their personal data or to object to its processing by written communication to the Academy. Personal data on Participants’ health will only be processed by the Academy, Selection Panel and/or those designated medical services providers exclusively for assessing the Participants’ suitability for participating in the relevant stages of the Program.
GDPR Disclosure – The General Data Protection Regulation (GDPR) provides a number of protections for the collection and use of your personal data. Any personal information that you provide in connection with the Promotion shall be used by Zwift to administer this Program, contact Participants, and for the other purposes set forth in the Sponsor’s privacy policy located at http://zwift.com/p/privacy. By participating in this Program, you agree to Sponsor’s collection of personal information and accept their privacy policy. If Participant authorizes, by opting in, Sponsor may provide Entrant with information relating to products, services and promotions of Sponsor and affiliates of Sponsor. Participation in this Program using the Zwift Service is subject to the Sponsor’s Terms of Service located at http://zwift.com/p/terms. Your personal data/registration information will be transferred to the United States. Pursuant to EU law pertaining to data collection and processing, you have a right of access to, modification and withdrawal of your personal data. You also have the right of opposition to the data collection, under certain circumstances. To exercise such right, you may email info@zwift.com.
Rights to Use Name and Likeness
Participant irrevocably grants to Zwift, its agents, contractors, successors, assigns and licensees the right, but not the obligation, to a worldwide, perpetual, non-exclusive, royalty-free, gratis license to use, photograph, record, reproduce, render, portray, recreate and depict the Participant’s name, biographical information, visual representation, likeness, registration, video and voice, in connection with the marketing, promotion and other commercialization of Zwift and the Program in such manner as Zwift may determine in its sole discretion.
Force Majeure
Sponsor reserves the right, in its sole discretion, to terminate, modify or suspend the Academy or Program if, in Sponsor’s opinion, the Academy or Program is not capable of running as planned by reason of pandemic, travel restrictions, strikes, natural disasters or any other factors beyond Sponsor’s reasonable control that could affect the administration, security, fairness, integrity, or proper conduct of the Academy or Program.
Release and Waiver
By virtue of Participant’s participation in the Program, Participants agree that Zwift and their partners, affiliates, advertising and promotion agencies, and their directors, employees, representatives and agents, partners and prize suppliers have no liability whatsoever for, and will be held harmless by Participants for any liability for any injury, loss or damages of any kind (including death) to persons, and property damages sustained, due in whole or in part, directly or indirectly, from participation in this Program or any Program or Zwift Academy Triathlon Team-related activity. Usage of the Zwift platform and participation in Zwift Rides/Runs/Events are at Participant’s own risk. Participant understands and acknowledges that Participant should not attempt any exercise that is beyond their skill/health level.
Additional Governing Terms
These Terms & Conditions shall otherwise be subject to and supplemented by the general Zwift Terms of Service, which are incorporated herein by this reference.
The Academy and qualification or designation thereof will align to the rules of the International Triathlon Union (ITU) and the IRONMAN Group.
